Email: info@bellanzari.com
Chamber of Commerce No.: [To be filled]
VAT No.: [To be filled]

2. Scope of Terms

2.1 These terms and conditions govern all transactions and offers from Bellanzari. A digital version is always accessible on our website, and a printed version can be sent upon request.
2.2 By completing a purchase, customers accept the stated delivery and payment policies. Bellanzari reserves the right to update these terms after the current term ends.
2.3 Unless agreed upon in writing, Bellanzari does not recognize any third-party general or special conditions.
2.4 Bellanzari guarantees that all delivered goods conform to the contract and the specifications outlined in the offer.

3. Delivery Terms

3.1 Deliveries are subject to product availability.
3.2 In accordance with remote sales regulations, Bellanzari will process orders within four business days. If this is not feasible (e.g., due to product unavailability or delay), customers will be informed within three days and may cancel the order.
3.3 Delivery is deemed complete once the package has been offered to the recipient once. In cases of refusal, a carrier's report serves as proof of delivery.
3.4 Stated delivery timelines are approximate and not legally binding.

4. Pricing

4.1 Prices are fixed for the validity duration of the offer unless legal changes or supplier price adjustments occur.
4.2 Bellanzari is not liable for typographical or printing mistakes on the website.
4.3 All listed prices are in euros and include 21% VAT.

5. Return Policy / Right of Withdrawal

5.1 Customers purchasing under consumer law (Dutch Civil Code Article 7:5) have the right to return products within 60 days of receipt without explanation. The return must be communicated in writing within this period and shipped back in original, unused condition, with packaging and all included documentation. Evidence of return must be provided (e.g., shipping proof). If these conditions are met, Bellanzari will reimburse the full purchase and original shipping costs within five business days. Bellanzari covers the return shipping expenses.

6. Customer Data

6.1 Customer information submitted during ordering is stored in Bellanzari's database. Bellanzari adheres to data protection regulations and never shares customer data with third parties.
6.2 The privacy of our website users is respected at all times.
6.3 Emails may occasionally be sent; each message includes unsubscribe instructions.

7. Product Warranty

7.1 Bellanzari guarantees product reliability, usability, and durability within reason and in accordance with the product manufacturer’s warranty.
7.2 The warranty term is 365 days from delivery. This does not cover fit-for-purpose claims for specific customer needs or misuse based on advice given.
7.3 Any issues with a product must be reported in writing within two months of receipt. Returns should be unused, undamaged, and in original packaging. Continued use or resale after noticing a defect voids warranty rights.
7.4 If a claim is valid, Bellanzari may replace the item or provide compensation. Liability is limited to the product’s purchase value or the coverage amount of our liability insurance. Bellanzari excludes all responsibility for indirect or consequential losses.
7.5 Bellanzari is not liable for intentional or recklessly caused damage by third parties.
7.6 This warranty does not apply if the buyer:
- Fails to meet payment obligations
- Modifies or repairs items without approval
- Mishandles the product
- Is affected by government regulations affecting product materials

8. Promotional Offers

8.1 Offers are not binding unless explicitly stated.
8.2 Bellanzari can revise or cancel an accepted offer within three business days.
8.3 Verbal promises are binding only when confirmed in writing.
8.4 Offers are not automatically valid for repeat purchases.
8.5 Any obvious pricing or content error voids the offer.
8.6 Any changes or additions must be formally documented.

9. Purchase Agreements

9.1 A sale is confirmed only after Bellanzari deems the order feasible.
9.2 Orders can be refused without explanation or accepted under conditions like prepayment or cash on delivery.

10. Images and Specifications

10.1 All visuals and technical descriptions on the site (e.g., size, color, weight) are approximations and cannot justify a contract cancellation or damage claim.

11. Force Majeure

11.1 Bellanzari is not responsible for failure to meet obligations due to external, uncontrollable events.
11.2 These include but are not limited to supplier issues, power outages, internet failures, transport disruptions, strikes, government restrictions, or illness.
11.3 In such cases, Bellanzari may suspend or cancel the agreement without liability.
11.4 Partial fulfillment of an order prior to the force majeure event may be invoiced separately.

12. Liability

12.1 Bellanzari is not liable for damages from improper product use. Always follow usage instructions.
12.2 Customers are warned not to use leather gel on suede gloves. Damages from misuse are not covered.

13. Retention of Ownership

13.1 Ownership remains with Bellanzari until all payment obligations are fulfilled.
13.2 Products under retention cannot be used as payment or pledged.
13.3 The customer may not burden the products with any claims.
13.4 Bellanzari has the right to reclaim unpaid goods and may access premises if necessary.
13.5 If third parties assert claims on such goods, the customer must notify Bellanzari immediately.
13.6 The customer must insure these goods and show proof of coverage when requested.

14. Governing Law and Jurisdiction

14.1 All agreements fall under Dutch law.
14.2 Disputes shall be handled by the competent court in Amsterdam, unless Bellanzari opts to bring the case before the buyer’s local jurisdiction, except when it concerns a subdistrict matter.
